1. Introduction

These Terms and Conditions apply to your use of jakariaahmed.com and to website-related services provided directly by Jakaria Ahmed.

By using this website, submitting an enquiry, requesting a consultation, accepting a quotation, placing an order, or making a payment, you agree to these Terms and Conditions.

If a separate quotation, proposal, invoice, Fiverr order, Upwork contract, or written agreement contains different terms, the project-specific agreement will take priority for that project.

2. Services

Services may include:

  • WordPress website design and development

  • Elementor website development

  • Website redesign

  • Landing page development

  • WooCommerce setup and customization

  • WordPress bug fixing

  • Website migration

  • Speed optimization

  • SEO improvements

  • Malware removal and security improvements

  • Website maintenance

  • Responsive design fixes

  • Technical consultation

  • Other website-related services agreed in writing

The exact services, deliverables, price, delivery time, and revision allowance will be confirmed before the project begins.

Submitting an enquiry does not guarantee that a project will be accepted.

3. Quotations and Project Scope

A quotation or proposal is based on the information provided by the client at the time it is prepared.

The agreed price covers only the services and deliverables listed in the quotation, proposal, order, invoice, or written project agreement.

Any request outside the original scope may require:

  • An additional fee

  • A revised delivery time

  • A separate quotation

  • A new order or milestone

Additional work may include new pages, new features, major design changes, extra integrations, additional products, content writing, or changes to previously approved work.

A project will normally begin after the required payment, content, information, and website access have been received.

4. Client Responsibilities

The client is responsible for providing accurate and complete information needed to complete the project.

This may include:

  • Website login details

  • Hosting or server access

  • Domain or DNS access

  • Brand guidelines

  • Logo files

  • Images

  • Written content

  • Product information

  • Business details

  • Legal policies

  • Feedback and approvals

  • Access to third-party services

The client confirms that they have permission to use all content, images, logos, software, accounts, and other materials supplied for the project.

The client is responsible for ensuring that supplied content does not violate copyright, privacy, trademark, advertising, or other applicable laws.

Delays in providing content, access, feedback, approval, or payment may extend the delivery date.

5. Payments

Payment terms will be confirmed in the relevant quotation, proposal, invoice, order, or project agreement.

Depending on the project, payment may be required:

  • In full before work begins

  • Through an advance payment

  • Through project milestones

  • Through Fiverr, Upwork, or another agreed platform

Work may be paused if a payment is overdue.

Final delivery, website transfer, administrator access, source files, or ownership rights may be withheld until all agreed payments have been received.

The client is responsible for transaction fees, marketplace fees, currency conversion charges, taxes, or third-party charges unless otherwise agreed.

6. Revisions and Additional Changes

The number of revisions included in a project will be confirmed before work begins.

A revision means a reasonable adjustment to work already completed within the agreed project scope.

A revision does not include:

  • A completely new design

  • A new page

  • A new feature

  • A different project direction

  • Additional functionality

  • Work not included in the original agreement

Revision requests should be clear, specific, and submitted together where possible.

Additional revisions or changes outside the agreed scope may require an extra fee and additional delivery time.

7. Project Timeline and Delays

Delivery times are estimates unless a fixed deadline has been confirmed in writing.

The delivery date may be extended because of:

  • Delayed client feedback

  • Missing content

  • Missing login access

  • Scope changes

  • Hosting problems

  • Plugin or theme conflicts

  • Third-party service issues

  • Delayed payment

  • Technical problems outside reasonable control

If the client does not provide the required content, access, payment, or feedback for 30 days, the project may be paused or considered inactive.

An inactive project may need to be rescheduled based on availability. A restart fee or revised quotation may apply if the project resumes after a long delay.

8. Cancellation and Refunds

Advance payments or deposits cover reserved project time, planning, communication, setup, and work already completed.

Unless otherwise agreed, deposits are non-refundable after work has started.

If the client cancels the project:

  • Payment remains due for work already completed

  • Third-party expenses are non-refundable

  • Completed work may not be used until fully paid

  • Any possible refund will be based only on the uncompleted portion of the project

Refunds are not normally provided because the client changes their mind, changes business direction, delays the project, no longer needs the service, or requests work outside the agreed scope.

Projects completed through Fiverr, Upwork, or another marketplace are also subject to that platform’s cancellation and refund policies.

9. Third-Party Tools, Themes, Plugins and Hosting

WordPress websites may use third-party services such as:

  • Hosting providers

  • Domain registrars

  • WordPress themes

  • Plugins

  • Page builders

  • Payment gateways

  • Email services

  • Analytics tools

  • Security services

  • Backup services

  • Fonts

  • Stock images

  • External APIs

These products and services are controlled by their respective providers.

I cannot guarantee that third-party products will always:

  • Remain available

  • Remain free

  • Continue working with WordPress

  • Support future updates

  • Maintain the same features

  • Remain free from bugs or security issues

The client is responsible for purchasing, renewing, and maintaining required licences, subscriptions, hosting, domains, email services, and third-party accounts unless otherwise agreed.

10. Website Security, SEO and Performance

Reasonable efforts will be made to provide secure, functional, responsive, and properly configured website services.

However, no website can be guaranteed to be completely free from:

  • Hacking

  • Malware

  • Security vulnerabilities

  • Hosting failure

  • Third-party software issues

  • Data loss

  • Downtime

  • Future compatibility problems

Malware removal or security improvements do not guarantee that a website will never be attacked again.

SEO services do not guarantee a specific ranking, traffic level, number of leads, sales, or business results.

Speed optimization does not guarantee a specific PageSpeed Insights, GTmetrix, Core Web Vitals, or performance score unless confirmed in writing.

Website performance may be affected by hosting quality, plugins, themes, images, videos, analytics scripts, advertisements, visitor location, device type, and internet connection.

11. Website Testing and Client Approval

The client is responsible for reviewing the website before approving or launching it.

The client should check:

  • Website content

  • Contact details

  • Images

  • Links

  • Forms

  • Email notifications

  • Prices

  • Product information

  • Payment settings

  • Shipping settings

  • Desktop layout

  • Tablet layout

  • Mobile layout

  • Legal information

  • Third-party integrations

Approval may be given through email, message, marketplace acceptance, payment, or a clear instruction to launch the website.

Changes requested after approval or launch may be treated as additional work.

12. Ownership and Intellectual Property

Ownership of custom final work created specifically for the client will transfer after full payment has been received.

This does not include:

  • Unpaid work

  • Rejected designs

  • Draft concepts

  • Third-party themes

  • Plugins

  • Fonts

  • Stock images

  • Open-source software

  • Developer tools

  • Reusable code

  • Non-transferable licences

Third-party products remain subject to their own licence terms.

The client may not copy, publish, sell, transfer, or use unpaid work.

The content, design, branding, and original materials published on jakariaahmed.com may not be copied, reproduced, scraped, resold, or distributed without written permission.

13. Portfolio, Reviews and Testimonials

Unless confidentiality has been agreed in writing, completed public-facing work may be displayed in:

  • My portfolio

  • Social media posts

  • Case studies

  • Proposals

  • Fiverr or Upwork profiles

  • Marketing materials

This may include the client’s business name, public website link, website screenshots, project description, and publicly shared review.

Passwords, private information, customer records, payment information, and confidential business materials will not knowingly be published.

Reviews or testimonials voluntarily provided by clients may be used for promotional purposes. Minor corrections may be made for spelling, formatting, or length without changing the original meaning.

14. Post-Project Support and Maintenance

Any included support period will be confirmed in the project agreement.

Post-project support normally covers small corrections directly related to the original agreed work.

It does not normally include:

  • New pages

  • New features

  • Content updates

  • New integrations

  • Hosting problems

  • Website changes made by others

  • Plugin or theme updates

  • Malware after delivery

  • Ongoing maintenance

  • New design requests

WordPress websites require regular updates, backups, security monitoring, licence renewals, and maintenance.

Unless an ongoing maintenance plan has been agreed, future support, updates, repairs, or changes may require an additional fee.

15. Liability, Disputes and Governing Law

I will not be responsible for indirect losses such as lost profit, lost sales, lost opportunities, business interruption, search-ranking changes, loss of data, or problems caused by third-party services.

Where liability cannot legally be excluded, the maximum liability relating to a project will not exceed the amount paid for the specific service that caused the claim.

I am not responsible for problems caused by:

  • Client changes

  • Another developer

  • Hosting providers

  • Third-party software

  • Expired licences

  • Weak passwords

  • Client devices

  • Server outages

  • Changes made after project delivery

If a concern or dispute arises, both parties should first try to resolve it through reasonable written communication.

Projects completed through Fiverr, Upwork, or another marketplace may also be subject to that platform’s dispute process.

These Terms and Conditions are governed by the laws of Bangladesh. Any legal dispute will be handled by the appropriate courts of Bangladesh unless mandatory law requires otherwise.
